You can make backups and that is not a problem. However the license key will only run on one domain but it will run on localhost so you can use that as a testing server.

1. A lot of people do not upgrade very often or wait a while before they do.
2. This version is still being developed...

Plus making custom php code changes makes upgrading difficult because you then have to go and change everything again. This is the reason for the modules and the template system.
